Terms of Service

These terms are the agreement between you and Tower of Wellness, a business operating in California ("Tower of Wellness", "we", "us") covering your use of towerofwellness.com, anything you buy from us, and your membership if you hold one. By using the site or placing an order you accept them. If you do not accept them, please do not use the site.

Two other documents sit alongside this one and control where they overlap: our Privacy Policy, our Consumer Health Data Privacy Policy, and our Shipping & Returns policy.

Nothing here is medical advice

This is the most important term in this document, so it comes first. Everything on this site — product pages, the Remedy Room, the Wellness Kitchen, the Sound Sanctuary, the digital library and the Functional Assessment — is educational. It is not medical advice, not a diagnosis, and not a substitute for care from a qualified clinician who knows your history.

Do not use this site to diagnose or treat anything. Do not delay seeking medical care because of something you read here, and do not stop or change a prescribed medication on the strength of it. Talk to your doctor or pharmacist before starting any supplement, particularly if you are pregnant or nursing, have a medical condition, or take prescription medication. If you think you may have a medical emergency, call your doctor or 911.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease.

Where this site describes how a plant or ingredient has traditionally been used, that is a statement of history and custom. It is not a claim that the ingredient does anything, and it is not a recommendation that you use it.

The Functional Assessment

The Functional Assessment is a questionnaire that organises what you tell us and suggests products from our range that are commonly associated with the areas you flagged. It is an educational tool and a shopping aid.

It is not a diagnostic test. It does not detect, rule out, or measure any disease or deficiency, no clinician reviews your answers, and its output is not a treatment plan. Your answers are health data and are handled under our Consumer Health Data Privacy Policy, which gives you the right to have them deleted.

A standalone assessment costs $25.00. It is delivered digitally and is included with membership.

Accounts

You need an account to hold a membership or to save an assessment. Accounts, passwords and order history are held by Shopify on our behalf. You are responsible for keeping your login details to yourself and for what happens under your account. Tell us promptly if you think someone else has access to it.

You must be at least 18 years old to create an account or place an order, and you must give us accurate information.

We may suspend or close an account that is being used to break these terms, to defraud us, or to abuse other people.

Membership

Membership comes in two tiers. Essential at $20 a month or $200 a year, and Complete at $30 a month or $300 a year. Both give you access to the members' areas of this site, at least one Functional Assessment a month, and free standard shipping on orders you place after joining, while your membership is active. The Complete tier additionally includes a second assessment each month and 10% off every product.

• It renews automatically at the end of each billing period — monthly or annually, whichever you chose — at the price then in force, until you cancel.
• You can cancel whenever you like, from your account or by emailing us. Cancelling stops the next renewal.
• Access runs to the end of the period you have paid for. You keep the members' areas until then; we do not cut you off on the day you cancel.
• We do not refund part-used periods, except where the law requires it or where we have got something wrong. See Shipping & Returns.
• If we change the price, we will tell you before it takes effect and you will have the chance to cancel first.

Membership is for one person. Please do not share your login, and do not republish members' content elsewhere.

Orders, prices and availability

Placing an order is an offer to buy. We accept it when we send the goods. We may decline or cancel an order — and will refund you in full if we do — where an item is out of stock, where a price or description was wrong, or where we suspect fraud.

Prices are in US dollars and exclude tax and shipping unless we say otherwise. We can change prices at any time, but a change never affects an order we have already accepted. Payment is taken through Shopify; we never see or store your full card details.

Our content

The text, photography, recipes, assessment questions, illustrations, logos and design on this site belong to Tower of Wellness or to our licensors, and are protected by copyright and trademark law. Some photography is used under free licences and is credited in our source files.

You may read, print and use this material for your own personal, non-commercial use. You may not republish it, sell it, scrape it, feed it into a commercial dataset, or present it as your own.

Using the site properly

• Do not break the law with it, or use it to harm anyone.
• Do not try to break, overload, probe or gain unauthorised access to the site, its accounts or its infrastructure.
• Do not scrape it or copy it in bulk by automated means.
• Do not impersonate anyone or misrepresent who you are.
• Do not upload anything unlawful, misleading, or infringing, and do not send us other people's health information.

Other companies we rely on

The site runs on Cloudflare, and commerce, accounts and payments run on Shopify. Those companies have their own terms and privacy policies, which apply to their part of the service. Links to other sites are for convenience; we do not control them and are not responsible for them.

Disclaimers

We work hard to keep this site accurate, but we provide it "as is". We do not promise that it will be uninterrupted, error-free, or that the information on it is complete or current. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Some states do not allow certain exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent the law allows, Tower of Wellness is not liable for indirect, incidental, special or consequential losses, or for lost profits or lost data, arising from your use of the site or our products. Our total liability to you for any claim is limited to what you paid us in the twelve months before it arose.

Indemnity

If your misuse of the site, or your breach of these terms, causes a claim against us, you agree to cover our reasonable costs in dealing with it.

Changes

We may update these terms. The version number and effective date at the top will change, and continued use after that date means you accept the new version. Where a change materially affects members, we will tell members directly.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and the state and federal courts located in Los Angeles County, California have exclusive jurisdiction. Nothing here prevents you from bringing a claim in small claims court, or limits any right you have under California consumer law that cannot be waived by agreement.
